Artificial Intelligence Policy for Customers

Introduction

Artificial intelligence (“AI”) is a transformational technology that offers new opportunities and challenges to our Customers. Wistia is committed to the responsible use of AI in conjunction with its service offerings that Wistia’s Customers can incorporate into their Customer Content, while minimizing the risk of unforeseen consequences and protecting Customer Content. The purpose of this policy (the “AI Policy”) is to explain how Wistia incorporates AI into the Services.

Capitalized terms used in this policy are defined in Wistia’s Terms of Service. You can find Wistia’s Terms of Service here.

AI Uses

Wistia’s Services integrate publicly available AI platforms to benefit our Customers (any such platform, an “AI Platform,” and any AI application or software available at an AI Platform or through the Services, an “AI Tool”). During the Content creation process, You may choose to use AI to (i) generate transcripts, summaries, key words and metadata, or other suggested text based on Your Customer Content, (ii) divide Your Customer Content into chapters, (iii) translate Your Customer Content and the corresponding transcripts; (iv) identify key segments within Your Customer Content, (v) generate scripts for use with Your Customer Content, (vi) generate descriptions and captions of Your Customer Content in real time, (vii) correct or enhance audio within Your Customer Content, and (viii) otherwise manipulate or generate Content relying on Your Customer Content or for use with Your Customer Content. All Content generated on Your behalf by an AI Tool is referred to as “AI Content.” Please see Appendix A for a list of functions performed by AI Platforms.

If You choose to use AI during the content creation process, Wistia and the AI Platform will have access to the Customer Content that You enter into, submit, or otherwise provide to Wistia and the AI Platform, as well as all AI Content generated from such Customer Content. Please be mindful of the Content You share with any AI Platform or AI Tool, including any Personal Information (as that term is defined in Wistia’s Privacy Policy), such as protected health information covered under the Health Insurance Portability and Accountability Act or other sensitive personal information. Wistia takes all commercially reasonable measures to protect all Personal Information and Customer Content in our Services, but Wistia cannot guarantee the privacy or security of information You share with third parties, including information shared with AI Platforms. Personal Information you enter into, submit or otherwise provide to AI Platforms will be governed by the privacy policy, artificial intelligence policy, and other policies of each AI Platform.

Please note that AI Tools may generate Content that is incomplete, inaccurate, incorrect, inappropriate or otherwise not reflective of Your or Wistia’s viewpoints. Wistia does not guarantee the accuracy or appropriateness of any AI Content generated while using the Services. Similarly, AI Content is not necessarily eligible for copyright or patent protection, and Wistia does not guarantee any intellectual property rights associated with any AI Content generated while using the Services.

Your use of AI must comply with Wistia’s Terms of Service. Noncompliance may result in limitations to Your use of the Services or the termination of Your account.

Future AI Uses

From time to time, and as necessary to meet business needs, to improve or expand the Services, or to otherwise enhance the experience of or assist our Customers, Wistia may incorporate new AI Platforms into and implement additional AI Tools on its Services. From time to time, Wistia may update this AI Policy and other relevant policies to reflect the use of these AI Platforms and AI Tools.
