Wistia Acceptable Use Policy
Customer shall not upload, download, post, submit, generate, or otherwise distribute any Customer Content or input or output using the Services in a manner that:
1. Violates Law or Rights of Others
- Violates any applicable law or regulation.
- Infringes any patent, trademark, trade secret, copyright, right of publicity, or other proprietary rights.
- Invades privacy or misappropriates personal data.
- Facilitates fraud, scams, deceptive practices, or unlawful commercial activity.
2. Harmful or Abusive Content
Customer may not use the Services to create, distribute, or promote content that:
- Promotes violence, terrorism, or criminal activity.
- Exploits, abuses, or endangers children.
- Harasses, threatens, or abuses individuals or groups.
- Contains hate speech, discriminatory attacks, or harmful stereotypes.
- Promotes suicide, self-harm, eating disorders, or other harmful conduct.
3. Illegal or Regulated Activities
Customer may not use the Services to facilitate:
- Sale or promotion of controlled substances or regulated goods without authorization.
- Real-money gambling or payday lending.
- Trafficking in weapons, hazardous materials, endangered species, body parts, or other illegal goods.
- Distribution of stolen goods or personal information.
4. Impersonation and Deceptive Media
Customer may not create or distribute content that:
- Impersonates an individual without consent or legal authority.
- Misrepresents the identity of a speaker or individual.
- Replicates the recognizable voice, likeness, or persona of another person without authorization.
- Creates deceptive synthetic media intended to mislead others.
5. Political Manipulation and Election Interference
The Services may not be used to:
- Suppress or disrupt voter participation.
- Impersonate political candidates or government officials.
- Disseminate misleading election-related information.
- Conduct political campaigning or advocacy related to elections.
6. Security and Platform Integrity
Customer may not:
- Introduce malware, viruses, or malicious code.
- Attempt to gain unauthorized access to systems or data.
- Interfere with the security, integrity, or availability of any network or system.
- Send spam or unsolicited mass communications.
7. Restrictions on AI Training and Model Development
Customer may not use the Services or output:
- As input to train machine learning or artificial intelligence models.
- As part of datasets used for training, fine-tuning, or improving AI systems.
8. High-Risk or Prohibited AI Uses
Customer may not use the Services for uses classified as “prohibited” or “high-risk” under applicable AI regulations, including the EU Artificial Intelligence Act.
Customers are responsible for independently determining their classification and compliance under applicable AI laws.
9. Government Entity Restrictions
Customer may not use the Services on behalf of or provide access to a Government Entity without prior written authorization from Wistia. “Government Entity” means any federal, state, provincial, regional, municipal, or local government or governmental body, authority, or agency.
10. Avatars and Likeness Rights
Customers creating avatars must ensure:
- The depicted individual has provided explicit consent.
- The avatar does not infringe intellectual property rights or publicity rights.
- The avatar does not depict minors or generate abusive or deceptive imagery.
Actors whose likeness is used retain the right to request removal of their likeness from the Services.
11. Conditional Content
Certain sensitive content may be permitted if it is:
- Educational, documentary, or informational in nature.
- Respectful and non-explicit.
- Clearly labeled where appropriate and not targeted toward minors.
Wistia may determine whether such content is permissible at its sole discretion.
12. Enforcement
Wistia may monitor use of the Services through automated systems, user reports, and human review.
If a violation occurs, Wistia may:
- Remove violating content
- Suspend or terminate access to the Services
- Cooperate with law enforcement where required.
Reports of abuse may be sent to abuse@wistia.com.
13. Policy Updates
Wistia may revise this Acceptable Use Policy from time to time. Changes become effective upon posting, and continued use of the Services constitutes acceptance of the updated policy.
